1. Definitions

1.1 "The Organization" means KissiCakes-n-Sweets, LLC.

1.2 "Terms" means the terms and conditions.

1.3 "Products" means any items offered for sale by the Organization.

1.4 "Customer" means any company, business or individual who places an order with the Organization for Products.

1.5 "Contract" means the acceptance by the Organization of an order placed by a customer and such acceptance shall occur when the Organization processes an order or when the Organization accepts the order and informs the customer. By submitting an order through our website you agree to the terms set forth.

2. Contracts

2.1 These terms shall apply to every contract.

2.2 The Organization may ask for any information it requires to fulfill the contract and the organization will not be liable for non-performance if the necessary information is not provided. The organization will do its best to fulfill its obligation.

3. Price

3.1 All quoted prices by the Organization are only valid at the time the contract is executed and are exclusive of any other issues unless otherwise agreed.

3.2 The Organization reserves the right to revise the quoted price in the event of unforeseen and extraordinary expenses for the Organization as pertained to the Products.

4. Payment

4.1 Products will only be released or delivered to the customer when payment has been received in full in cleared.

4.2 Payment can be made online, with a credit or debit card through PayPal, a secure third party payment processor.

5. Samples

5.1 If the Organization presents a customer with a sample, this will not constitute a sale and it’s merely a representation of the different types and quality of our Products.

6. Delivery

6.1 If the customer selects the delivery option, the organization will only deliver to the customer and not a third party. The Organization must be informed in via email of alternative delivery instructions. If customers are unavailable to accept delivery of Products after 1 attempt then customer will have to pick up their product at our business location or pay for additional delivery attempts.

6.2 The Organization will not accept any liability for late delivery of the Products and delivery time will not be of the essence of the contract.

6.3 The Organization will not accept liability for non-delivery, where this is caused by circumstances beyond its control.

6.4 All risks shall pass to the consumer upon delivery.

6.5 All delivery costs will be paid by cleared funds by the customer to the Organization before delivery will take place.

7. Warranty

7.1 The Organization warrants that the Products will be fresh and free from defects at the time of dispatch.

7.2 The customer must notify the Organization of any defects within 24 hours of delivery.

8. Returns policy

8.1 Due to the consumable nature of our products, there’s absolutely no refund or exchange on any order once delivered. However a customer can cancel an order and receive full refund if the cancellation occurs before the order is processed.

8.2. Customers have a 2 day period within which they can cancel their orders.
